HEARTLAND HIGHSPEED FIBER, LLC PRIVACY POLICY

I. POLICY SUMMARY
Protection of each subscriber’s personal information is important to Heartland Highspeed Fiber, LLC (“HHF”). It is the intent of this policy to establish and disclose HHF’s practices regarding the collection, use, retention, protection and distribution of that personal information. This privacy policy shall be reviewed intermittently to affirm compliance with HHF’s business practices, policies and applicable state and federal laws.
II. COLLECTING PERSONAL INFORMATION
The type and amount of personal information HHF collects depends upon the scope of service provided. Personal information may include, but is not limited to:
· Information provided by the subscriber on an application for broadband or VoIP services, such as address, Social Security number, date of birth and contact information.
· Information provided by the subscriber or gathered in relationship to HHF’s business practices or based upon transactions with HHF, such as credit card information, bank account numbers, routing and/or transit numbers and credit history.
A subscriber’s name or the fact the subscriber receives services from HHF shall not be considered personal information.
III. USING PERSONAL INFORMATION
HHF uses personal information primarily for the purpose of providing broadband, VoIP and related HHF services and maintaining the subscriber’s account. HHF employees shall be advised of the sensitive nature of collected data and shall not disclose or use subscriber’s personal information for any purposes other than conducting the business of HHF, except: (1) where required by law; (2) in order to establish, exercise or defend HHF’s legal rights; (3) where required by the Articles of Organization or Operating Agreement of HHF; (4) with the express written consent of the subscriber; or (5) a subscriber’s own personal information if requested by the subscriber during regular business hours, but only upon the subscriber’s ability to establish his or her identity pursuant to HHF’s current identify theft and subscriber identification policies.
IV. SMS MESSAGING
In addition, HHF may use a subscriber’s personal information, such as phone numbers, to send SMS (text) alerts if such subscriber opts in to SMS alerts for account notifications. When a subscriber opts in to receive SMS messages, HHF collects the subscriber’s mobile number and consent to send SMS messages. HHF uses such information to send the subscriber the SMS messages such subscriber has opted in to receive, provide service and outage updates based on the subscriber’s preferences, and operate the business of HHF. A subscriber can opt out of receiving SMS messages at any time by replying STOP to any message that HHF sends. A subscriber can receive support by replying HELP to any message that HHF sends.
HHF may use a subscriber’s mobile phone information for the purposes described in Article III of this policy. However, HHF will not share subscribers’ personal information or phone numbers with third parties or affiliates for marketing or promotional purposes. HHF will not share subscribers’ mobile opt-in data or SMS consent with anyone.
Subscribers who opt in will receive recurring SMS alerts and messages from HHF. Message and data rates may apply. Carriers are not liable for any delayed or undelivered messages. V. MAINTAINING AND PROTECTING PERSONAL INFORMATION
HHF shall take reasonable technical and organizational precautions to protect against loss, misuse or alteration or personal information. Such precautions include:
· Firewalls
· Secure servers
· Password protected computer stations
· Encryption technology
· Restricted access to facilities and/or storage units
· Establishment of policies for the prevention and mitigation of identity theft
Such precautions do not provide a guarantee that personal information cannot be accessed, altered or deleted due to physical, electronic or procedural failures but are intended to be HHF’s reasonable precautions to protect the personal information of its subscribers.
VI. DISTRIBUTING PERSONAL INFORMATION
Personal information will not be leased or sold by HHF. Personal information shall not be shared with third parties or subcontractors, with the exception of those elements necessary to conducting the business of HHF and/or as requested or authorized by the subscriber.
VII. POLICY REVISION AND RESPONSIBILITY
It shall be the responsibility of each HHF employee to comply with this policy. It shall be the responsibility of the Chief Executive Officer to maintain and enforce this policy. It shall be the responsibility of the Board of Managers to periodically review this policy and authorize modifications deemed necessary to protect the private information of subscribers.
